Intellectual Property Complaint Guide

Article 1 Introduction

1.1 Eugooo (hereinafter referred to as "the Platform" or "we"), operated by Shenzhen Jietong Gongying Cross-border Supply Chain Co., Ltd., respects and protects intellectual property rights. As an M2B information matching platform, we are committed to maintaining a fair and healthy business environment and firmly oppose any acts of intellectual property infringement.

1.2 This Intellectual Property Complaint Guide (hereinafter referred to as "this Guide") aims to provide clear channels and procedures for rights holders (hereinafter referred to as "you") to file infringement complaints.

1.3 This Guide is developed in accordance with the E-Commerce Law of the People's Republic of China, the Copyright Law of the People's Republic of China, the Trademark Law of the People's Republic of China, the Patent Law of the People's Republic of China, the Regulations on the Protection of the Right to Network Dissemination of Information, and other relevant laws and regulations.

1.4 If you believe that content on the Platform infringes upon your intellectual property rights, please submit a complaint in accordance with the requirements of this Guide.

Article 2 Types of Complaints

2.1 The Platform accepts the following types of intellectual property infringement complaints:

(i)Copyright Infringement: including but not limited to unauthorized use of works such as text, images, videos, software, audio, design drawings, and product manuals;

(ii)Trademark Infringement: including but not limited to unauthorized use of others' registered trademarks, similar trademarks, trade names, etc.;

(iii)Patent Infringement: including but not limited to unauthorized implementation of invention patents, utility model patents, or design patents;

(iv)Trade Secret Infringement: including but not limited to disclosure or improper use of technical information, business information, and other trade secrets;

(v)Other Intellectual Property Infringement: including but not limited to enterprise name rights, domain name rights, and anti-unfair competition matters.

2.2 Please select the appropriate complaint category based on the type of intellectual property right that has been infringed.

Article 3 Complaint Requirements

3.1 To ensure effective complaint handling, please submit complete and accurate complaint materials. Incomplete or unclear complaints may result in processing delays.

3.2 Each complaint should target only one rights holder and one type of intellectual property. If multiple rights holders or multiple types of intellectual property are involved, please submit separate complaints.

3.3 Complaint materials shall include:

(i)Proof of Identity of Rights Holder:

- Individual: copy of valid identity document (ID card, passport, etc.);

- Enterprise: copy of business license, proof of legal representative identity;

(ii)Proof of Intellectual Property Rights:

- Copyright: copyright registration certificate, proof of first publication of the work, originality declaration, etc.;

- Trademark Rights: trademark registration certificate, registered trademark design;

- Patent Rights: patent certificate, patent specification;

- Trade Secrets: relevant evidence proving the establishment of trade secrets and their infringement;

(iii)Evidence of Infringement:

- Specific link or screenshot of infringing content;

- Detailed description of infringing content;

- Other materials proving the fact of infringement;

(iv)Statement from Rights Holder:

- Infringement statement signed or sealed by the rights holder, including:

- The complainant is the infringed rights holder or their lawful agent;

- The complaint content is true and accurate;

- The complainant is willing to bear legal liability for false complaints.

Article 4 Complaint Procedures

Step 1: Submit Complaint

Step 2: Material Review

Upon receiving the complaint materials, we will conduct a preliminary review. The review period is usually3-5 working daysafter receiving complete materials.

If materials are incomplete, we will notify you to supplement them during the review period.

Step 3: Notify the Accused Party

If the complaint materials are deemed valid after review, we will send written notice to the accused party, informing them of:

(i) The specific infringing content and link;

(ii) The complainant's claims and basis;

(iii) The accused party's right to make statements and defense.

Step 4: Response from Accused Party

The accused party may submit written defense materials within5 working daysafter receiving the notice, including:

(i) Explanation and evidence that the conduct does not constitute infringement;

(ii) Proof materials for lawful use;

(iii) Other relevant statements.

Step 5: Platform Decision

We will make a handling decision within5 working daysafter receiving the accused party's response:

(i) If infringement is established, the infringing content will be deleted or blocked;

(ii) If infringement is not established, the complaint will be dismissed and relevant content will be restored;

(iii) If determination cannot be made, both parties will be informed to further negotiate or resolve through legal channels.

Article 5 Counter-Complaint Procedures

5.1 If you, as the accused party, believe that your content does not constitute infringement, or that your rights have been improperly infringed, you may appeal through the following methods:

(i) Submit written defense materials to xiaojiel@eugooo.com;

(ii) Provide evidence or explanation that the conduct does not constitute infringement in the defense materials;

(iii) If your content was incorrectly deleted due to false complaints from the rights holder, and the evidence is sufficient, we will restore your content after verification.

5.2 Rights holders who maliciously submit false complaints shall bear corresponding legal liability.

Article 6 Important Notes

6.1Truthfulness of Complaints: Please ensure the authenticity and accuracy of complaint content. Those who intentionally provide false complaint materials shall bear legal liability.

6.2Preliminary Evidence: As an information matching platform, the Platform does not have professional judicial appraisal capabilities. Evidence provided by the complainant will be used as preliminary evidence. If further determination is required, it is recommended to resolve through legal channels.

6.3Confidentiality Obligation: During the complaint handling process, both parties are obligated to keep trade secrets and privacy information confidential.

6.4Scope Limitations: The Platform only provides infringement complaint handling services and assumes no responsibility for any transaction disputes, contract performance, product quality, or other issues.

6.5Reservation of Rights: The Platform reserves the right to modify this Guide in accordance with changes in laws and regulations, and the modified Guide will be published on the Platform.
